Privacy Notice

Last updated: October 26, 2026

This Privacy Notice explains how Divergent Physics, Inc. collects, uses, discloses, and protects personal information when you use our website, accounts, desktop software, support, and related Services.

1. Information we collect

Account and contact information

We collect information such as your name, business email, company, credentials, support messages, and communication preferences when you create an account, request a demo, or contact us.

Commercial and license information

We process subscription status, plan, transaction identifiers, license entitlements, activation and expiration information, and related records. Payment card details are handled by our payment processor; we do not receive full card numbers.

Information you submit and local project context

Your project files remain on your workstation. The desktop application does not upload those project files to Divergent Physics or to the configured AI provider.

The application reads the project locally and provides the configured AI provider only with structured metadata and derived context needed to perform your request. This can include the project and model hierarchy; object or component names and properties; materials; parameters; analysis configuration; and relevant numerical results. It does not include the project file itself.

Prompts and messages—and images, scripts, or other material that you deliberately paste or upload into a feature—are processed to provide that requested feature and may be sent to the AI provider you configured. For enterprise deployments, that provider may be a trusted cloud or on-premises provider selected by the customer.

Operational information

We process IP address, device and operating-system information, app and solver versions, account and installation identifiers, authentication and license events, update requests, security events, and logs needed to operate and protect the Services.

Optional desktop product analytics

In the standard deployment, product analytics may include a pseudonymous user or installation identifier, session and trace identifiers, agent and tool names, feature events, model name, token counts, timings, success or failure status, error categories or messages, and diagnostic logs. Prompts and tool arguments are excluded from telemetry by default. Because free-form errors or logs can contain unexpected information, do not place secrets in file names or diagnostic messages.

Website analytics

Our website uses analytics services to collect page views, clicks and navigation, referral and campaign data, browser and device information, web-performance metrics, JavaScript errors, and—when enabled—session replay with form inputs masked. We honor supported browser Do Not Track signals for this collection.

2. How we use information

  • provide, authenticate, license, maintain, and support the Services;
  • process requested simulations, agent actions, and model interactions;
  • bill customers and administer subscriptions;
  • secure the Services, prevent abuse, troubleshoot failures, and enforce agreements;
  • understand feature use and improve reliability and user experience;
  • communicate about the Services, support, security, and material changes; and
  • comply with law and protect our users, company, and third parties.

We do not use your proprietary project context or material you submit to train a general-purpose AI model without express opt-in or a separate written agreement.

3. When we disclose information

We disclose information only as reasonably necessary to:

  • service providers such as hosting, infrastructure, analytics, payment processing, customer support, and security vendors;
  • the AI-model provider or customer-controlled endpoint configured for a request, which may include OpenAI, Anthropic, Google, a custom OpenAI-compatible endpoint, a local provider, or an enterprise customer's selected trusted cloud or on-premises provider;
  • professional advisers and transaction counterparties under appropriate confidentiality obligations;
  • government authorities or others when required by law or necessary to protect rights, safety, and security; and
  • a successor in a merger, financing, acquisition, reorganization, or sale of assets.

We do not sell your project data, submitted materials, or personal information.

4. Telemetry choices

You can enable Privacy Mode in the desktop application settings to stop optional product analytics, agent/tool traces, error-report events, and remote diagnostic-log forwarding. You may change the choice later.

Privacy Mode does not block authentication, license validation, update checks, or data sent to a configured AI provider at your request. Enterprise customers may select their own trusted cloud or on-premises provider. Customers requiring a contractual No-Telemetry or Air-Gapped deployment should use an enterprise Order Form incorporating the Enterprise Addendum.

5. Legal bases

Where applicable law requires a legal basis, we process information as needed to perform our contract with you, for our legitimate interests in operating and securing the Services, to comply with legal obligations, and with consent where we request it. You may withdraw consent for future processing, but this does not affect processing already performed or processing based on another lawful basis.

6. Retention

We retain account, transaction, license, support, and operational records for as long as reasonably needed to provide the Services, maintain security, resolve disputes, and meet legal obligations. Prompts, support uploads, and other material you deliberately submit are retained according to the feature used, your instructions, and any Order Form. Analytics data is retained only for a reasonable product-analysis period and may then be aggregated or deleted. Backups may persist for a limited period before rotation.

7. Security

We use administrative, technical, and organizational safeguards designed to protect information. No system is perfectly secure, and we cannot guarantee absolute security. You are responsible for protecting credentials, configuring provider accounts, and selecting a deployment appropriate for the sensitivity and regulatory status of your data.

8. International processing

We and our service providers may process information in the United States and other countries. Where required, we use appropriate contractual or legal safeguards for international transfers.

9. Your privacy rights

Depending on where you live, you may have rights to access, correct, delete, or obtain a copy of personal information; restrict or object to processing; withdraw consent; or appeal a decision. You may exercise a right by contacting us. We may verify your identity and may retain information where permitted or required by law.

We will not discriminate against you for exercising an applicable privacy right.

10. Children

The Services are intended for business users and are not directed to children under 18. We do not knowingly collect personal information from children.

11. Third-party links and services

The Services may link to or integrate with third parties. Their privacy practices are governed by their own notices, not this one. Review the terms and privacy settings of each selected integration, including your solver, model provider, payment processor, and—for enterprise deployments—any trusted cloud or on-premises provider.

12. Changes to this notice

We may update this notice to reflect changes in the Services, our practices, or law. We will post the updated notice with a new date and provide additional notice when required.
